Microsoft's Own Terms of Use Say Copilot Is for Entertainment. Your Marketing Team Uses It for Strategy.
Microsoft's Copilot terms of use page says something that doesn't get enough attention. In plain text, right at the top: "Copilot is for entertainment purposes only. It can make mistakes, and it may not work as intended. Don't rely on Copilot for important advice."
This is the same tool that Microsoft markets for writing business documents, analyzing spreadsheets, building presentations, and summarizing emails. The product page shows professionals using it to draft proposals and manage projects. The terms of service page says it's entertainment. Both pages are live. Both are from Microsoft.
Exactly What the Terms Say (and What They Don't)
The official Copilot terms of use are surprisingly blunt about limitations. Microsoft makes "no warranty or representation of any kind about Copilot." They can't promise responses won't infringe copyrights or trademarks. They can't promise accuracy. And they explicitly warn that "sometimes, the sources Copilot uses may not be reliable, relevant, or accurate."
The terms also include this: you are solely responsible if you choose to publish or share Copilot's responses publicly or with any other person. So if your marketing team uses Copilot to write ad copy that makes a false claim, or to research a competitor analysis that gets the numbers wrong, that's on you. Microsoft has already disclaimed responsibility in the document your team agreed to without reading.
This isn't hidden in page 47 of a legal document. It's the opening statement of the terms of use.
The Split That Changes Everything
There's a critical distinction buried in the terms that most of the Hacker News discussion about this missed. The terms page explicitly states: "These Terms don't apply to Microsoft 365 Copilot apps or services unless that specific app or service says that these Terms apply."
Translation: Microsoft 365 Copilot, the $30/user/month enterprise product that lives inside Word, Excel, and Teams, operates under separate commercial terms with actual enterprise data protection commitments and Microsoft's standard Products and Services Data Protection Addendum.
The free consumer Copilot at copilot.microsoft.com, the one you access through Bing, the one your team members probably use for quick research and brainstorming because it doesn't require an enterprise license: that's the entertainment product.
Here's where the practical problem shows up. Most marketing teams use both versions without distinguishing between them. A content strategist might use the enterprise M365 Copilot in Word to draft a brief, then switch to the free Copilot in their browser to fact-check a statistic or brainstorm headline options. One of those interactions has enterprise terms behind it. The other is, according to Microsoft, entertainment.
I've seen enough marketing ops setups to know that almost nobody tracks which Copilot their team uses for what. The license distinction exists in the IT department's procurement records, not in the marketer's workflow.
Why "Entertainment" Is a Deliberate Legal Choice
This isn't sloppy legal writing. It's a liability strategy. By classifying consumer Copilot as entertainment, Microsoft is doing two things simultaneously.
First, they're creating a ceiling on damages in any future lawsuit. If a user claims Copilot gave them incorrect information that led to a business loss, Microsoft can point to the terms: this was entertainment, not professional advice. You were told not to rely on it. The legal term is "assumption of risk," and it's hard to argue around explicit disclaimers you agreed to.
Second, they're isolating the enterprise product from consumer product liability. If courts eventually rule that AI tools carry a duty of care (something consumer protection advocates have been pushing for), the entertainment classification creates a firewall. Enterprise Copilot might face scrutiny. Consumer Copilot was never claimed to be anything serious.
The contradiction with how Microsoft markets the product is obvious, and several legal observers on Hacker News have pointed out that courts sometimes reject disclaimers that directly contradict a company's marketing. But that's a fight for future litigation. Right now, the terms say what they say.
And the pattern across every major AI provider is the same: market aggressively, disclaim broadly. OpenAI is already selling ads inside ChatGPT answers, which raises its own set of questions about trust and reliability. The tools get integrated into critical business workflows while the legal frameworks stay in "not our problem" mode.
What to Actually Change in Your AI Workflow This Week
The action here isn't to stop using Copilot. It's to understand what you're using and what protections you actually have.
Step one: figure out which Copilot your team is actually using. If you're on a Microsoft 365 E3/E5 plan with Copilot licenses, the version inside your Office apps has enterprise terms. If your team is also using copilot.microsoft.com in a browser, or the Copilot sidebar in Edge, that's the consumer version. Different product, different terms, different liability.
Step two: document your AI-assisted outputs. If consumer Copilot helps generate ad copy, research data, or strategic recommendations, someone on your team needs to verify the output before it goes live. Not because the tool is bad (from what I've seen, it's actually pretty useful for brainstorming), but because the company that built it just told you in writing not to trust it for anything important.
Step three: if your organization handles any regulated content (financial claims, health-adjacent marketing, FTC-compliant disclosures), route those tasks to the enterprise version or don't use AI at all. The liability gap between "entertainment tool produced this" and "enterprise tool with commercial terms produced this" is the kind of detail that matters if something goes wrong.
The Liability Gap Nobody Is Managing
I don't think Microsoft intended for this to become a marketing story. The terms page has been there for a while, and it reads like standard legal defensiveness. But the gap between how AI tools are marketed and how they're disclaimed is getting wider every quarter. And it's the marketing teams, not the engineering teams or legal teams, who are sitting in that gap.
The uncomfortable question isn't whether Copilot is reliable enough for business use. For a lot of tasks, it probably is. The question is what happens when it isn't, and you're holding a terms of service that says the whole thing was entertainment.
